Secondment vs freelance vs employer of record: which fits your hire.

Three models bring the same external specialist into your team, with very different risk and cost profiles. The short version: freelance is for genuine independents on scoped work, secondment is for embedded work you direct, and employer of record extends secondment logic across borders. The detail below.

The three models in one minute

What is direct freelance?

You contract the specialist's own business directly. Fast and light, and the classification risk is yours: if the working reality looks like employment, EU misclassification rules can reclassify it, with back payments attached.

What is secondment?

The specialist is employed by a staffing firm and seconded to you. You direct the day-to-day work; the employer carries payroll, contributions and labour-law obligations. The engagement can be long and embedded without a classification problem, because it is employment by design.

What is employer of record?

A licensed partner employs the specialist in their own country, compliant with local labour law, while you direct the work and hold one commercial contract with your agency. It is how you employ someone in Germany, Sweden or Spain without opening an entity there.

Choose freelance when

  1. The specialist genuinely runs a business: multiple clients, own tools, real economic risk.
  2. The work is a scoped deliverable, not a seat in your team.
  3. The engagement is short and the specialist controls how the work gets done.

Choose secondment when

  1. The specialist works embedded in your team, under your direction, for months.
  2. You want flexible capacity without the misclassification exposure.
  3. Temp-to-perm is a realistic outcome and you want a clean conversion path.

Choose employer of record when

  1. The specialist sits in a country where you have no entity.
  2. Local rules make direct contracting risky: AÜG licensing in Germany, requalification in France, and their equivalents.
  3. You want one contract and one point of accountability across markets.

Cost, risk and speed compared

Freelance shows the lowest headline rate and carries the highest hidden risk; a reclassification means retroactive employer contributions. Secondment and EOR quote all-in rates where employment costs are inside the number, which reads higher and prices the risk at zero. On speed, freelance starts fastest, secondment and EOR follow within days once the employment is set up. The legal background per market is in our EU contractor compliance guide.

Frequently asked questions

Which model is fastest to start?

Direct freelance, when the specialist is genuinely independent. Secondment and EOR add days for employment setup, not weeks, and remove the classification risk that can stop a freelance engagement mid-flight.

Which model is cheapest?

Freelance looks cheapest because the rate is bare, but you carry the compliance risk and its potential back payments. Secondment and EOR rates are all-in: employment costs, contributions and compliance are inside the number you see.

Can I switch models mid-engagement?

Yes. A freelance engagement that grows embedded can be converted to secondment or EOR, and seconded specialists regularly convert to permanent hires. Converting early is cheaper than defending a reclassification later.
