Two German rules shape every engagement

First, Scheinselbständigkeit. If a freelancer works embedded in your team, under your direction, mostly for you, German authorities can determine the relationship is employment, with back payment of social contributions. The Statusfeststellungsverfahren exists precisely to test this. Senior AI work, which is typically embedded and directed, sits in the risk zone by default.

Second, the AÜG. Supplying labour in Germany requires an Arbeitnehmerüberlassung licence. An agency that places a contractor into your team without a compliant structure creates exposure on both sides of the contract. The clean cross-border answer is delivery through a licensed local employer: the specialist is employed in Germany by a licensed partner, you direct the work, and the classification question is closed by structure.
